jimmy-iovine-crop-324x285Beats will launch its Beats Music service in the United States within the next couple of months, reports The Next Web. The service will be available via the web and an iOS app, directly competing with other available music services like Spotify, Pandora, Rdio, and Apple's newly released iTunes Radio.

According to Beats COO and president Luke Wood, Beats Music will focus on both content curation and playlists, with Beats hiring employees to create playlists based on artists, activities, and moods. iTunes Radio is also heavily curated.

"We’re going to focus really heavily on playlists, because that’s how we consume music and that’s how most people consume music."

"We’re talking about real depth of personalization and knowing who I am, who you are, what we’re listening to, what we like, what we’ve listened to before and then offering up music that is highly relevant to our taste profile."

Prior to the launch of both Beats Music and iTunes Radio, Beats CEO Jimmy Iovine met with Apple executives to discuss its music subscription service, called "Project Daisy" at the time.

While Apple CEO Tim Cook and SVP of Internet Services Eddy Cue expressed interest in Beats’ model and rollout plans, no deal emerged between the two companies. Despite that, Apple and Beats maintain a close relationship, with Apple retail stores offering Beats products and using Beats by Dre headphones to demo iPods and other products.

This weekend, Samsung began running new television ads for its Galaxy Gear smart watch. The ads, which have received positive feedback from critics, pay homage to the first ads from another revolutionary device: the iPhone.

The ad from Samsung uses movie clips from "Star Trek", "Dick Tracy", "Knight Rider", and others with actors using their watches to communicate. The clip ends with a normal person using their Samsung Galaxy Gear, referencing a long-running pop culture fascination with wrist phones.

Six years ago, Apple used a similar ad to introduce the iPhone during the 2007 Academy Awards, stringing together movie clips of characters answering the phone.

Apple is rumored to have a smart watch in development that would compliment existing iOS devices with biometrics and other feature integration. It is expected to be released sometime late next year.

Following several months of investigation, the Securities and Exchange Commission (SEC) has concluded its review of Apple’s finances and opted not to take any action against the company at the current time, reports AllThingsD.

subcommittee.jpg
While the SEC has ultimately decided that Apple's disclosures are sufficient, it has asked Apple to improve the language of its SEC filings to make it easier for investors to understand the risks of its tax strategies. As noted by The Wall Street Journal, Apple has agreed to provide the information, detailing the names and tax rates of the countries where it maintains foreign cash.

Apple Inc. will give investors more information about its overseas cash and related tax policies, following a review by the Securities and Exchange Commission over the summer, according to correspondence released Thursday.

The SEC demanded additional disclosures about Apple’s fiscal–2012 annual report, including “a more tailored discussion” of risks associated with Apple’s tax structure.

It also asked Apple to detail the names and tax rates of the countries where Apple houses its foreign cash.

The investigative conclusion by the SEC comes after much scrutiny from the U.S. Senate Permanent Subcomittee on Investigations this past summer, which claimed Apple avoided paying $74 billion in taxes between 2009 and 2012 through the use of international subsidiaries and complicated tax strategies.

Apple CEO Tim Cook, CFO Peter Oppenheimer and Head of Tax Operations Phillipp A. Bullock all appeared in front of the subcomittee on Capitol Hill in May, with the company releasing a statement prior to the hearing about its international and financial operations. During his testimony, Cook told the senate that Apple pays all of the taxes that it owes in the country.

In April, Apple borrowed $17 billion in a bond offering, in part to return cash to shareholders without bringing a portion of its $100 billion overseas to the United States. While Apple holds approximately $145 billion in cash and investments, roughly two-thirds of that money is currently held in foreign countries and would be subject to significant taxes if it were to be returned to the United States, with the bill estimated to have been at $13 billion if it were enforced.

Apple told the SEC that it plans to use its foreign cash to invest abroad, creating additional Apple Stores overseas, expanding its iTunes Store, and boosting its international marketing.

canaccord_iphoneIn a note published to clients late last week, a survey by investment research firm Canaccord Genuity (via Fortune) revealed that the new iPhone 5s was the top-selling phone at all four major U.S. carriers in September, with the lower-cost iPhone 5c second in sales at AT&T and Sprint. The Samsung Galaxy S4 placed ahead of the iPhone 5c in sales at Verizon and T-Mobile, with the firm attributing strong sales of Samsung's flagship device to price cuts initiated in June.

"We believe these price cuts combined with Samsung's aggressive marketing and effective advertising campaign for its existing and new high-tier smartphones, such as the recently-launched Galaxy Note 3, could potentially help Samsung reduce high-tier smartphone share losses to Apple in October despite the strong iPhone 5s and 5c demand."

In September, Apple announced that sales of the iPhone 5s and iPhone 5c surpassed nine million during their launch weekend, breaking previous records set by past iPhones. Analytics firm Localytics also shared data that also revealed the iPhone 5s outsold the iPhone 5c by roughly 3.5x during the launch weekend as measured by customer usage.

Apple has begun to make significant progress on the construction of its future campus in Austin, Texas, judging by photos of the project sent to AppleInsider. The last report of progress on the campus came in December of 2012 as basic work began, with the new photos showing advancements toward the construction of multiple buildings, a working fountain and a filled pond, along with complete fences and sidewalks.

austin_campus2

When complete, the Austin site will be used as the company's "Americas Operations Center." The new facility is being built in two stages. The first stage, seen in these photos, is slated to add 200,000 square feet of office space at a cost of $56 million. The second stage, scheduled to begin in 2015, will create 800,000 square feet of operating space.

austin_campus1
The plans for the new campus were announced in March 2012 after Apple committed to spend $304 million on the Texas project, with 3,600 employees expected at the new facilities. After government approvals, Apple was then able to purchase the land in July 2012, which is when work began. The campus is expected to see full completion by the end of 2021, with the bottom 10 percent of the workers at the facility reportedly receiving an average yearly salary of $35,000, and contractors being paid a minimum of $11 per hour.

Progress on the expanded Austin campus comes as plans for Apple's future "Spaceship" campus in Cupertino, California were approved by a regulatory commission last week. That project appears set for a final approval vote on November 19 that would leave it on track for a 2016 opening.

iTunes Radio, Apple's streaming music service that debuted alongside iOS 7, is currently limited to users in the United States. That may change in the near future, however, as Apple appears to be preparing to launch the service in Canada.

itunes radio
Apple recently added a new job listing (via 9to5Mac) seeking an iTunes Canada Music Programmer, who will be responsible for overseeing the programming of iTunes Radio in Canada.

The Canadian Music Programmer will be responsible for the programming of iTunes Radio and the iTunes Music store in Canada. This particular role will report directly to the Head of Music for the Canadian iTunes store, and will be responsible for working cross-functionally across a variety of teams including Editorial, Label Relations, Marketing, Sales, Production & Engineering, and more.

The Canadian Music Programmer will be an editorial voice of iTunes Radio, and will be responsible for keeping the product current. This person must have a passion for and deep knowledge of music across numerous genres and decades, and must demonstrate the ability to objectively program content relevant to iTunes customers.

Job responsibilities for the position include identifying and promoting new songs and priority releases, highlighting content, and managing the weekly scheduling and programming process.

Apple’s first music service, iTunes Match, also debuted exclusively in the United States back in November of 2011 before rolling out to international markets a month later.

Though Apple has not hinted at a timeline for the international availability of iTunes Radio, it is possible that the rollout of the service could follow a similar timeline, becoming available over the coming months as Apple negotiates licensing deals for each country.

According to Apple’s senior vice president of Internet software and services Eddy Cue, bringing iTunes Radio to the rest of the world is a top priority for the company, and it is aiming to be in "more than 100 countries."

forstallApple's senior vice president of worldwide marketing Phil Schiller and former senior vice president of iOS software Scott Forstall may testify in the upcoming partial damages retrial between Apple and Samsung, reports PCWorld. Forstall has been largely out of the public eye since being ousted from Apple in late 2012.

Set for November 12, the trial follows judge Lucy Koh's March ruling that struck $450 million from the $1 billion in damages awarded to Apple in August 2012.

According to Koh, the jury may have miscalculated the original damages due to a misunderstanding of patent issues, resulting in a lump sum award that did not distinguish between patent violations. With a lump sum award, the court was unable to determine which part of the damages were applicable to each infringing patent.

Ahead of the retrial, both Apple and Samsung have filed a joint statement that includes a list of potential witnesses, and on Apple's side, both Forstall and Schiller are listed.

Apple's list includes Phil Schiller, the company's senior vice president of worldwide product marketing, and Scott Forstall, the former senior vice president of iOS software. Forstall's departure was announced last October following the widely criticized launch of Apple Maps, which some observers said may have led to his firing. Both Schiller and Forstall also testified in the original trial.

Also on the Apple witness list is Susan Kare, who designed some of the icons for Apple's original Macintosh in the 1980s.

The new trial could result in an award that favors either Apple or Samsung, depending on whether the amount awarded is more or less than the original $450 million that was thrown out. Regardless of the outcome, Samsung remains responsible for the remaining $600 million for the original jury decision.

iphone5c-headerFollowing announcements from Best Buy and RadioShack that they will be offering $50 gift cards to iPhone 5c customers that will bring the prices down to $50 for a 16 GB model with a two-year contract, Walmart will be undercutting even those offers starting today by dropping its pricing to $45, reports MarketWatch.

While Best Buy's current offer is good only through next Monday and RadioShack's is scheduled to run for about a month, Walmart's pricing will be valid throughout the holiday shopping season. Walmart has been offering the iPhone 5c for $79 since launch, a $20 discount from standard pricing.

Price drops around the holidays are not terribly unusual for major iPhone retailers, but stores are being rather aggressive in announcing price drops on a brand-new iPhone model so soon after launch. iPhone 5c models have been in relatively good supply since their launch, while the more expensive iPhone 5s has seen significant shortages. The iPhone 5s has not seen any significant sale announcements, although Walmart has been offering the 16 GB model for $189, a $10 discount from normal pricing, since launch.

Apple has added new 'Tips and Tricks' sections to its iPhone marketing websites, giving new and old iPhone users a handy guide to the new features of iOS 7 and the new iPhone models.

The three pages, one each for the iPhone 4s, 5c and 5s, include sections about photography, swipe gestures, FaceTime, Maps, Siri, Calendar, Music, Mail, Safari, AirPlay and Wireless, Settings, Compass, and Find My iPhone.

The pages, which are linked at the bottom of every iPhone marketing webpage on Apple.com, appear to be something of a quick start guide, complimenting the more in-depth iPhone User Guide.

Jonathan Zufi, who runs the Shrine of Apple website, has spent the last several years collecting and photographing Apple’s huge array of products, from rare releases to everyday items. He’s amassed 150,000 photos, 650 of which will appear in his new 326-page book, "Iconic: A Photographic Tribute to Apple Innovation."

iconic
Zufi interviewed with The Wall Street Journal, where he described how he purchased more than 500 Apple items and traveled across the country to photograph prototypes and other rare products.

"I wanted to create a repository where people who also love the company and its products could go and reminisce," says Mr. Zufi, a mobility expert at SAP America Inc. who says he has never worked for Apple Inc. The idea, he says, was to trace the company’s evolution both in electronics and design from a user’s point of view. "I want people who are a bit younger who think Apple just makes things that start with "i" to know this company used to make clunky printers."

The book includes photographs of rare Apple products like the Apple II, a circuit board from the Apple I, the “Flower Power” iMac G3, and an Apple Lisa 2. It also features more modern products like iPods, and also offers an entire chapter on packaging. The book has little text, but it does offer forewords and introductions from original Apple employees like Daniel Kottke and Steve Wozniak.

"Iconic: A Photographic Tribute to Apple Innovation" is self-published and can be purchased on the website dedicated to the book. There are two versions, a classic edition that retails for $75 and a $300 special edition that includes a cover designed to mimic the vintage Apple form factor.

As noted by ABC News, Best Buy yesterday began a brief promotion offering $50 off of the price of the iPhone 5c. With the 16 GB model normally priced at $99.99 on a two-year contract in the U.S., the discount cuts pricing on the device to just $49.99. The offer brings the cost of the higher-capacity 32 GB model down to $149.99 with a contract.

best_buy_iphone_5c_gift_card
The discount, which comes in the form of a gift card that can be applied to the in-store iPhone purchase itself, comes just two weeks after the device's launch and beats Walmart's $79.99 pricing on the 16 GB model that has been available since launch.

iPhone 5c supplies have remained fairly strong throughout Apple's distribution channels, giving retailers some incentive to reduce pricing to help drive sales. That availability contrasts with significant shortages seen for Apple's flagship iPhone 5s, most acutely with the silver and gold models.

The $50 gift card offer on the iPhone 5c is valid through Monday, October 7.

Update: RadioShack will be offering a similar promotion starting tomorrow, with in-store iPhone 5c purchasers eligible for a $50 gift card they can apply to the purchase of their devices. The promotion will run through November 2. Customers can also take advantage of RadioShack's Trade & Save program to receive up to $250 in store credit for trading in their current iPhones.

originaliphoneJust ahead of the second anniversary of Steve Jobs’ death, Fred Vogelstein has published a piece in The New York Times that gives a detailed behind-the-scenes look at the work that went into both the first iPhone and its January 9, 2007 announcement, featuring information from key iPhone developers like Andy Grignon, Tony Fadell, and Scott Forstall.

According to Andy Grignon, the senior manager in charge of the radios of the iPhone, the night before the iPhone announcement was terrifying. Jobs had insisted on a live presentation of the prototype iPhone, which was still in the developmental stages, often "randomly dropping calls, losing its Internet connection, freezing, or simply shutting down."

The iPhone could play a section of a song or a video, but it couldn’t play an entire clip reliably without crashing. It worked fine if you sent an e-mail and then surfed the Web. If you did those things in reverse, however, it might not. Hours of trial and error had helped the iPhone team develop what engineers called “the golden path,” a specific set of tasks, performed in a specific way and order, that made the phone look as if it worked.

At the time of the announcement, only 100 iPhones existed, with some of those featuring significant quality issues like scuff marks and gaps between the screen and the plastic edge. The software, too, was full of bugs, leading the team to set up multiple iPhones to overcome memory issues and restarts. Because of the phone’s penchant for crashing, it was programmed to display a full five-bar connection at all times.

Then, with Jobs’s approval, they preprogrammed the phone’s display to always show five bars of signal strength regardless of its true strength. The chances of the radio’s crashing during the few minutes that Jobs would use it to make a call were small, but the chances of its crashing at some point during the 90-minute presentation were high. "If the radio crashed and restarted, as we suspected it might, we didn’t want people in the audience to see that," Grignon says. "So we just hard-coded it to always show five bars."

Apple had poured all of its efforts into the iPhone, and its success largely hinged on a flawless presentation. As described by Grignon, there was no backup plan in place if the presentation was a failure, which put enormous pressure on the team.

Jobs rarely backed himself into corners like this. He was well known as a taskmaster, seeming to know just how hard he could push his staff so that it delivered the impossible. But he always had a backup, a Plan B, that he could go to if his timetable was off.

But the iPhone was the only cool new thing Apple was working on. The iPhone had been such an all-encompassing project at Apple that this time there was no backup plan.

Though there were a huge number of factors that could have caused the presentation to fail, it famously went off without a hitch. Grignon shares a final story on how the engineers and managers that worked on both the iPhone and the presentation shared a flask of Scotch as they watched "the best demo any of us had ever seen."

The full piece, which explores thoughts from other key Apple employees like Tony Fadell and Scott Forstall, is well worth a read. It covers the overwhelming complexity of developing an entirely new product and the extreme lengths that Jobs and his team went to keeping the product a secret.

Apple India executives Maneesh Dhir and Sanjay Kaul have stated in a meeting with retailers that the company will be focusing on consumers in small cities and towns in the country in order to grow sales, reports The Economic Times (via The Next Web).

The executives state that Apple desires to build 100 exclusive standalone stores under the franchise model in smaller markets, and will aim to do so by the end of the current fiscal year. The company is precisely interested in the changing demographic of the market, with both executives feeling that the aspiration level of Apple products amongst the youth are growing along with the population of wealthy citizens.

istore_hyderabad_india

The move comes amid Samsung's success in the Indian hinterland, said a senior executive with a retail chain, besides which companies such as Sony and Nokia have been able to sell smartphones costing in excess of 30,000 in areas outside the metros. The 16 GB iPhone 5 costs 45,500. India pricing for the upcoming iPhone models - the 5C and the 5S - hasn't been announced yet.

"Apple has realised that if it wants to grow fast in India, it has to look beyond the metros," said the CEO of one of India's retail chains. The company wants to grow upwards of 30% year-on-year in India and feels the smaller markets would play a critical role since the aspiration level of Apple products amongst the youth and rich is growing there as well.

India notably does not have any Apple Retail Stores in its country; however a report in January 2012 stated that Apple was interested to build stores in the country after business regulations were eased. Apple was also planning for 'significant growth' of its reseller network in India as reported last March.

Figures from research firm Canalys reported in August for Q2 2013 showed that India is now the third largest smartphone market in the world, with 129% growth in the region resulting in 9 million smartphone shipments during the quarter. Apple CEO Tim Cook also mentioned during the company’s Q3 2013 earnings call that iPhone sales in India were increased by 400% year-on-year, while the iPad posted double-digit growth in the region, highlighting the potential for future growth in the market.

Berlin-based Security Research Labs has detailed various exploits within the iPhone 5s' Touch ID security feature and iOS 7 that allow would-be criminals to bypass the device's security features, reports Reuters.

The method for bypassing the Touch ID security feature found on the iPhone 5s is very similar to the one used by the Chaos Computer Club, which also claimed to hack Touch ID earlier this month. A video posted on the group’s website shows how Touch ID can be bypassed using information gathered from fingerprints left on the victim’s phone display, demonstrating that a photo taken with the iPhone 4s can be used for developing a mold.

Another video by the group outlines a scenario in which a knowledgeable criminal could steal an iPhone 5s running iOS 7, use Control Center on the lock screen (enabled by default) to turn on Airplane Mode and disable the device’s connectivity, then using a fingerprint mold to bypass the lock screen and disable other various security features. Ultimately, the group shows how an attacker could conceivably gain complete control of a victim's device, Apple ID, and even other services such as Google accounts.

The group ends the video by suggesting Apple do the following to increase security efficiency in iOS 7:

1. Make Airplane Mode inaccessible from the lock screen by default and require PIN after setting Airplane Mode or removing SIM Card
2. Warn users not to store password-reset email accounts on iDevices
3. When device is lost for good, advise users to revoke its privileges
4. Do not inform potential attackers how the device is protected
5. Upon reconnecting to the Internet, iOS should not allow email retrieval before the device’s wipe- or don’t-wipe status can be retrieved

Aside from any future changes Apple may make to increase security, users can already prevent the simple bypass of the Remote Wipe feature by turning off access to Control Center from the lock screen.

iOS 7 has recently been the subject of much praise by security officials, including the New York Police Department, which passed out flyers in New York City recommending users to update to iOS 7, along with government officials who have praised iOS 7’s Activation Lock. Meanwhile, Touch ID has been the subject of much scrutiny since its release, with U.S. Senator Al Franken sending a letter to Tim Cook asking a number of questions about the security of the system and the exact fingerprint storage process. Apple has also published an extensive knowledge base article about the benefits of the Touch ID system to alleviate some consumer concerns.

jobs_1955_2011With the second anniversary of Steve Jobs' death coming tomorrow, Apple CEO Tim Cook has sent a brief email to company employees reflecting on Jobs and the impact he continues to have on Cook and the company. The full email has been posted by 9to5Mac.

Team-

Tomorrow marks the second anniversary of Steve’s death. I hope everyone will reflect on what he meant to all of us and to the world. Steve was an amazing human being and left the world a better place.

I think of him often and find enormous strength in memories of his friendship, vision and leadership. He left behind a company that only he could have built and his spirit will forever be the foundation of Apple. We will continue to honor his memory by dedicating ourselves to the work he loved so much. There is no higher tribute to his memory. I know that he would be proud of all of you.

Best,

Tim

In the weeks following Jobs' death, Apple invited fans to leave remembrances to be shared on the company's website and held a private celebration of his life for company employees. The company marked the first anniversary of his passing last year with a photo and audio slideshow and message from Tim Cook posted on the front page of apple.com.
